TERMS AND CONDITIONS OF USE OF THE AQUAQUESTRIAN WATER TREADMILL (THE “FACILITY”)
1. Save for death or personal injury caused by negligence, the Facility does not accept any liability for any accident, loss, damage, injury or illness to riders, horses, owners, spectators, property, vehicles and their contents and accessories or any other person or property whatsoever, whether caused by their negligence, breach of contract or in any other way whatsoever during their attendance at the AquaEquestrian Water Treadmill at Chiltern Vale Farm, Stokenchurch (the “Premises”).
2.Working with horses and handling horses can be dangerous and horses may be unpredictable. Persons attending any water treadmill sessions do so at their own risk and the Facility will not be held responsible for any accident, injury or loss.
3. The "Owner(s)" is/are the person(s) attending the water treadmill sessions at the Premises, who are also responsible for any spectator, groom or observer in attendance at the Premises with the Owner. The Owner is advised to wear, and ensure other handlers wear, a riding hat conforming to the current standards and suitable footwear when handling horses at the Facility.
4. Any water treadmill session may be rearranged at any time up to 24 hours before the session by using the online portal. Any no show or cancellation will not be refunded for any reason.
5. The Facility reserves the right to cancel any booking without notice. The Facility reserves the right to refuse any booking. The Facility cannot be held responsible for any consequential loss or liability howsoever caused.
6. All Owners under the age of 18 years must be accompanied by a responsible adult and must be kept under control at all times.
7. Owners and their grooms, spectators and observers must not cause a nuisance or disturbance to any other person at the Premises.
8. The Facility is not responsible for other persons/animals using the Premises and/or for any person unlawfully using the Premises or trespassing onto the Premises.
9. Any Owner bringing a groom or other paid assistance onto the Premises must hold employers’ liability insurance.
10. Dogs are not permitted onto the Premises.
11. Owners and their grooms, spectators and observers must not take any glass or breakable objects on to the Premises.
12. The Facility reserves the right to request that Owners or any other person using the Premises do leave in circumstances where in the opinion of the Facility and/or its employees, a person is creating a dangerous situation, behaving in a dangerous manner and/or where a person is mistreating a horse or acting irresponsibly. Where an Owner or any other person is asked to leave they must immediately return to their mode of transport and remove the horse and themselves from the Premises.
13. Smoking is not permitted on the Premises. Please take litter home with you and clear all droppings/hay from the lorry park.
14. Owners are required to close the gates of the Premises whether entering or exiting the Premises and to obey all other signage.
15. The Facility ¡s not responsible for the provision of First Aid personnel or equipment on the Premises and cannot be held liable to provide First Aid. The Owner (or any responsible adult) agrees to ensure their own provision for First Aid.
16. All Owners, and any person accompanying them, must act in accordance with the current UK Government guidance regarding their use of the Premises, including (but not limited to) regular sanitisation, ensuring that no one within their group has any COVID-19 symptoms, and maintaining social distancing at all times while at the Premises.
17. All horses using the Facility do so at their Owners’ risk. The Facility does not accept any responsibility or liability for any injury suffered by any horse using the Premises.
18. Any bundle deals are only valid for a period of 6 months from the date of the commencement of the block booking for 6 sessions, or 12 months from the date of commencement for 10 sessions.
19. AquaEquestrian reserves the right, and by agreeing to these terms and conditions each Owner is deemed to consent to, the use of any photograph or video footage of any user of the water treadmill on the AquaEquestrian social media platforms and / or website, at its sole discretion.
By booking a session online, I confirm that I have read, understood and accept the above terms and conditions of the use of the water treadmill and confirm that I am using the Facility entirely at my own risk.
